The membership has many differing opinions on the Red Bull admitting rule (Rule 2.2). This rule will likely change at the November Annual Meeting, and the Breed Improvement Committee is recommending some changes to the ABHA Board. However, the question has come up regarding the legality of such rule. The opponents to the rule have sited AQHA court rulings dealing with cloning and hair color. The AQHA has lost some of these cases based upon the fact that they were limiting AQHA horses from registration. If the ABHA prevented ABHA cattle from being registered, then it would also have legal issues.
However, the AQHA has allowed Thoroughbred horses to be registered with the AQHA based upon certain qualifying criteria. Many breeders know this as the "Appendix Registry". For instance, if a Thoroughbred horse has a certain speed index then it can be registered in the AQHA even though it is not an AQHA horse.
Likewise, the ABHA can allow red Hereford bulls to be admitted to the ABHA if they meet certain qualifications. There is no legal limitation for such action. It is important for the members to understand this so that a frivolous lawsuit is not brought against the ABHA. The rule may change, but it is important to understand that the ABHA can limited which red bulls they admit into the ABHA. There will definitely remain qualifications such as genetic defect testing, even if the other EPD requirements are dismissed.

So did they change the rule of allowing any red sire to be registered now contingent on the person nominating the bull pay a fee.
